Vaughan Personal Injuries: What Happens When I’m Injured At Work

If you are injured at work or feel like something on the job has made you sick, you have a responsibility to report your injury to your supervisor immediately. If your supervisor is not available, go to the First Aid station and have someone let your supervisor know that you have been injured or become ill.

Tell your Employer About the Injury Right Away

Let your supervisor know if you develop any condition, such as a rash or burning eyes, that you believe developed due to something you were exposed to or doing at work. If you have to leave work to go to the doctor’s office or the hospital, your employer will pay your salary or wages for the rest of the day.

File a Claim with the WSIB

You are required to file a claim with the WSIB (Workplace Safety and Insurance Board) as soon as possible after the accident. If you lose wages or need health care treatment because of your injury or illness, your supervisor must also file a claim. Workers under the age of 16 years must have a parent or guardian sign part of the form.

See Your Doctor

You can see your own doctor about your work-related injury, but you cannot change doctors without WSIB approval. Tell the doctor that your injuries are work-related so that he or she can fill out the proper forms.

Your doctor will send a report about your injury or illness directly to the WSIB.

The WSIB will contact you when your claim has been filed. You have to follow all instructions from the WSIB, fill out all forms promptly and cooperate in your health care treatment and safe return to work.

If your WSIB claim is denied, you have the right to appeal.

Long-term Disability Insurance

You may still have coverage with Long Term disability insurance, either through work or a private plan, you should apply for benefits under this policy if you and your doctor feel you will not be able to return to work right away. Your human resources department will be able to provide you with a booklet explaining how to apply for benefits, what forms need to be filed, and how long the waiting period will be before you will be able to receive any money under the policy.

Some claims for long-term disability are denied by insurance companies. If you have applied for benefits and your claim has been denied, you need to contact a personal injury lawyer to help you fight for the benefits you are entitled to.
